Probate and Inheritance laws: Why there are necessary but shouldn’t have to be used

This is a slightly updated version of my previous article published on the Liberland Forum in August of 2025.

Everyone knows that when someone dies, someone else be it family, a close friend, or even a charity: inherits or gets the property of the deceased on whatever it is the deceased bestows upon them and the legal process of passing this property over to that other person is called probate – at least in common law countries it is. Personally I am going through this process now and have been for over 2 years now with no end in sight for me. Whenever that first person dies that is a citizen of Liberland there needs to be a process to dispose of the deceased’s property, but I don’t want it to be used unless it is absolutely necessary.

My solution to this problem is that everyone should place in the blockchain their will or some other type of legal instrument that says where their property should go and that the smart contract be executed upon the verification of their death as a smart contract. This would also be very helpful for life insurance or other types of legal instruments that are to be executed upon the death of someone like the transfer of a business, shares of stock, etc. I do not know how such a thing will be done but I do hope that people who are smarter than me in the blockchain space are already working on this and if they aren’t, they are at least inspired by me to start working on this issue and that would be to create templates for people that they can fill, modify or edit as necessary to file such documents.

Liberland merits as they are currently used, should I think be surrendered back to Liberland upon death and not be inheritable it is something that each person should earn for themselves and not be handed down because by there very nature they are earned by that person alone or if the people of Liberland are not comfortable with that idea then the estate can sell the merits at fair market value within a set number of days after death. The biggest problem I see moving into the future are, 2 classes of people in Liberland those with merits and those without. Much like how British Aristocracy’s titles are only handed down to the first born male the same will happen with Liberland Merits. Under the current system only 14,000 people can become citizens of Liberland based on the current 5,000 merit requirement to gain citizenship and that only if every person that is a citizen has 5,000 merits each which is certainly not the case even today the president himself has over 3.47 million merits alone, that’s enough merits to create 694 new citizens.

If Citizenship of Liberland is to be truly to be a meritocracy it should be earned by each person themselves not to become an inherited title like the British have. If the Senate is to be created in the form currently proposed siblings would fight over who gets the merits to gain their fathers senate seat, that is barbaric, antiquated and just down right backward to what the modern world is currently.
