Deep Dive Into The Citizenship Law

Liberland’s Citizenship Framework: Decoding the Law’s Text and Its Libertarian Divergence

As the Free Republic of Liberland continues to pioneer voluntary governance amid its disputed Danube enclave, questions about citizenship—its acquisition, scope, and uniqueness—resonate deeply among the 800,000 global applicants. This article focuses on the textual essence of Liberland’s citizenship provisions, drawn verbatim from its Citizenship Law. We dissect the absence of automatic birthright mechanisms (jus soli or jus sanguinis), contrast full citizenship’s rights with the statuses of Liberland Nationals and Honorary Citizens, and highlight how Liberland’s model upends traditional state-centric definitions. Rooted in the Citizenship Law, which vests legislative authority in a selective community of Citizens and ensures clarity, stability, and respect for the privilege of Citizenship, Liberland’s framework rejects coercion, embracing merit and consent as the bedrock of belonging.

The Legal Text: No Birthright, Only Earned Allegiance

Liberland’s citizenship law defines Citizenship as a set of rights and obligations as stipulated by this law and the Constitution. It is personal to each individual Citizen and shall not be transferable to any other person under any circumstances.

Key excerpts from Title 2: Acquiring Citizenship illuminate the deliberate void of automatic conferral:

Acquiring Citizenship Process: Any individual seeking Citizenship, hereinafter referred to as the “Applicant,” must complete the Acquiring Citizenship Process as a prerequisite for obtaining Citizenship. The Acquiring Citizenship Process shall consist of the following steps: Conducting due diligence on the Applicant; A Citizenship interview; Reviewing the Applicant’s commitment to Liberland, demonstrated through financial or other contributions fostering the development of Liberland; Payment of the costs incurred by Liberland in connection with the application process; An official recommendation by the Citizenship Commission to the President, confirming that the Applicant has successfully fulfilled all formal requirements for the granting of Citizenship; and The granting of Citizenship by the President.

Commitment Review: The Citizenship Commission shall permit an Applicant to obtain Citizenship only if the Applicant demonstrates sufficient commitment to Liberland. A total balance of 5,000 LLM or more, politically pooled into the Applicant’s Citizenship, shall be sufficient grounds for confirming the Applicant’s commitment for the purpose of granting Citizenship.

This language explicitly bars automatic acquisition. The text omits all references to birthright citizenship—neither by soil (jus soli, automatic for those born on the territory) nor by descent (jus sanguinis, inherited from parents). A comprehensive search across the law yields zero mentions of “birthright,” “jus soli,” “jus sanguinis,” or “by descent” in citizenship contexts as automatic grants.

Instead, Title 3: Liberland Nationals provides for Liberland Nationality by Descent or by Birth under specific conditions:

Liberland Nationality by Descent shall be registered by the Citizenship Commission and confirmed by the Minister of Interior upon the official registration of an individual’s birth by Liberland and the verification of their descent from at least one Liberland Citizen at the time of said individual’s birth. Registration of Liberland Nationality by Descent shall take place at any time before the individual’s 18th birthday. It is the responsibility of the individual’s parents or legal guardians to initiate this registration.

Liberland Nationality by Birth: Where a child is born on Liberland soil to parents the both of whom have started the Acquiring Citizenship Process and have been confirmed to fulfill the conditions for Citizenship besides the Commitment Review, the parents may petition the Minister of Interior within 30 days after the birth to grant the child Liberland Nationality by Birth, which shall afford its bearer the same rights as Nationality by Descent.

These provisions require registration, verification, and parental initiative, with criteria for Liberland Nationality being the same as those for Citizenship, except for a less stringent Commitment Review. No provisions extend automatic citizenship to minors via parents alone, diverging sharply from global norms where jus sanguinis prevails in 30+ countries (e.g., Italy, Ireland) and jus soli in 35 (e.g., USA, Canada).

In sum, Liberland’s law textualizes citizenship as an opt-in privilege, ensuring a citizenry of committed libertarians, not accidental inheritors.

Rights and Privileges: Full Citizenship vs. Liberland Nationals vs. Honorary Citizens

Liberland distinguishes full citizenship—a political and territorial bond—from Liberland Nationality and Honorary Citizenship.

Full Citizenship Rights (Per Title 1: Citizenship)

Citizens, post-naturalization and possessing 5,000 politically pooled Liberland Merits (LLM) in good standing, hold:

  • Full international protection afforded by Liberland;
  • Unconditional access to the territory of Liberland, whether physical or virtual;
  • The right to possess and use a Liberland passport and Liberland ID;
  • The ability to apply for and participate in the social system of Liberland;
  • Voting in elections for public offices in Liberland;
  • Voting in a Meritocratic Referendum and submitting proposals for such a Referendum;
  • Becoming a candidate for a public office in Liberland;
  • Participating in a Democratic Veto;
  • Running a validator.

Every Citizen shall fall under the jurisdiction of the Liberland Judiciary for relevant matters and comply with its judgments.

Textual anchor: “Citizenship constitutes a set of rights and obligations as defined by this law and the Constitution.”

Liberland Nationals Privileges (Per Title 3: Liberland Nationals)

Individuals connected to Liberland by virtue of their birth or descent may become Liberland Nationals, provided they fulfill the criteria for acceptance into the national community of Liberland. The criteria shall be the same as those for Citizenship, except for the less stringent Commitment Review.

  • Entitled to receive a Liberland National Passport upon request from the Ministry of Foreign Affairs, which shall grant them the full protection of Liberland while abroad.

Any Liberland National may freely renounce their Liberland Nationality through a written submission to the Citizenship Commission.

Honorary Citizens Privileges (Per Title 4: Honorary Citizens)

Honorary Citizenship is a status conferred upon individuals who are not Citizens of Liberland, granting them privileges similar to those of a Liberland National.

  • Unlike Liberland Nationals, Honorary Citizens shall be entitled to receive a Citizen’s passport upon request.

Honorary Citizenship may be granted to individuals who have made significant contributions to the establishment, prosperity, or reputation of Liberland, or to the advancement of liberty worldwide, by the Cabinet or the President.

This tiered structure reserves full sovereignty for merit-earned citizens while providing symbolic or honorary ties.

A Paradigm Shift: Liberland vs. the World’s Citizenship Models

Globally, citizenship is often an immutable accident of birth: jus soli grants it by birthplace (e.g., Brazil’s 100% automatic), jus sanguinis by bloodline (e.g., Japan’s descent-only). Dual citizenship is restricted in 70+ nations (e.g., China bans it), and naturalization demands years of residency (e.g., 5-10 in EU states) with oaths to coercive welfare states. Revocation is rare, even for traitors.

Liberland inverts this: Citizenship is earned and conditional, not inherited or imposed. No residency minimum—commitment via 5,000 LLM suffices. Revocation is swift for violations (e.g., serious crimes, treason), aligning with libertarian non-aggression over statist permanence. The social system allows withdrawal of voluntary tax with temporary suspension of voting rights, emphasizing voluntarism.

This textual fidelity to voluntarism—absent in UN-recognized states—positions Liberland as a radical experiment: Citizenship not as a lottery ticket, but a forged key to freedom.

For the full law, consult the Citizenship Commission. Aspiring citizens: Apply through the Acquiring Citizenship Process, demonstrate commitment, and claim what birth never could.
